What Is a Fair Car Accident Settlement in Mount Juliet and Lebanon?

In Wilson County, a fair car accident settlement generally runs $4,000 to $25,000 for a soft tissue injury to the neck, back or shoulder, $32,000 to $150,000 for a fracture or disc injury that heals, and $250,000 and up for an injury with lasting limits, under Tennessee's one year deadline, 50 percent fault bar and $750,000 cap on pain and suffering. In a chain crash on I-40, that total is usually split between the insurers of each driver at fault.

Typical values

What Wilson County crash claims are worth

Wilson County settlements are confidential, so the honest way to answer the question is with the valuation method itself, applied to the injuries these crashes cause. Tennessee law sets the rules, which is why the bands match the rest of the state.

Soft tissue: neck, back, shoulderA few weeks of care; bills between about $2,500 and $9,000.
$4,000 to $25,000
Fracture or disc injury that healsBills of roughly $12,000 to $40,000, weeks out of work.
$32,000 to $150,000
Injury that leaves lasting limitsFrequently surgical; bills over $60,000.
$250,000 and up

Statewide Tennessee method bands: medical bills times 1.5 to 2.5, 2.5 to 3.5 or 4 to 5, plus lost wages. Not court averages.

Two Wilson County facts matter more than the bands. The county's injury crash rate ranks 22nd of Tennessee's 95 counties, well above the other fast growing suburbs around Nashville: Sumner ranks 71st and Williamson 90th. And its commuters depend on one road, Interstate 40, where heavy traffic can stack into multi-car collisions in which two or three drivers share the fault. Tennessee generally makes each at fault driver pay only their own share, so a Mount Juliet claim often has to be collected from more than one insurer.

Multi-car crashes

When three drivers share the blame: chain crashes on I-40

Interstate 40 between the Davidson County line and Lebanon is Wilson County's main commuter route, and heavy morning and evening traffic is the setting for chain reaction collisions: one driver brakes, a second stops in time, a third does not, and the second car is pushed into the first. Each driver may carry part of the fault, and Tennessee's rules for dividing it are different from what most people expect.

Who pays
Each driver, for their own share

When the Tennessee Supreme Court adopted comparative fault in McIntyre v. Balentine (1992), it also did away with joint and several liability in most cases. An at fault driver generally pays only the percentage of the damages that matches their own share of the fault, so a claimant collects from each responsible driver's insurer separately.

McIntyre v. Balentine, 833 S.W.2d 52 (Tenn. 1992)
An uninsured driver in the chain
That share can go unpaid

If one of the at fault drivers has no insurance, their share is not shifted to the others. Your own uninsured motorist coverage is what fills that gap, which is why it matters even when another driver in the crash is well insured.

T.C.A. § 56-7-1201
Blame added later
A 90 day window

If a driver you sued answers by blaming someone you did not sue, Tennessee gives you 90 days from that answer to add the newly blamed person, even if the one year deadline has already passed.

T.C.A. § 20-1-119
Your own share
Under 50 percent

Your recovery is reduced by your share of the fault and barred at 50 percent. In a chain crash, a middle driver may be assigned a share too, for example for following too closely.

McIntyre v. Balentine (1992)

An example of the split. A Mount Juliet commuter, stopped in traffic and not at fault, is hit in a three car chain. A jury values the injury at $60,000 and assigns 70 percent of the fault to the last driver and 30 percent to the middle driver. The last driver's insurer owes $42,000 and the middle driver's owes $18,000. Two claims, two adjusters, one injury.

Reading the Wilson County rankings

  • Injury crash rate: 22nd of 95. Of the counties covered on our Nashville area pages, only Rutherford County ranks higher (6th); Montgomery ranks 30th, Sumner 71st and Williamson 90th. 2024 was the only year above 1,000 injury crashes, at 1,001.
  • Fatal crashes held steady at 19 to 23 a year, an average of 21, more than Sumner's or Williamson's average despite fewer drivers than either.
  • The fastest driver growth of the Nashville area counties covered here: licensed drivers rose 18 percent, from 122,755 to 145,112, against 17 percent in Rutherford, 16 percent in Montgomery, 13 percent in Williamson and 13 percent in Sumner.
  • Lebanon grew by a third. The Census Bureau's 2024 estimate puts Lebanon at 51,501, up from 38,486 in 2020, and Mount Juliet at 44,066, up from 39,312. Wilson County reached 169,948.
  • Older drivers in crashes rose 21 percent, from 639 to 774, and teen drivers 8 percent, from 749 to 812.

Worked examples

Three Wilson County claims, priced out

Hypothetical claims modeled on the patterns described on this page, not client results.

Hypothetical
The front car in an I-40 chain crash near exit 226

Stopped in westbound traffic at 7:20 AM. A pickup rear-ends the car behind, which is pushed into this driver. Whiplash and a shoulder strain, six weeks of therapy, a week off work. Fault: 70 percent to the pickup, 30 percent to the middle car.

Medical bills
$6,800
Income lost
$2,400
Multiplier, soft tissue
1.5 to 2.5
Claim range
$12,600 to $19,400
Pickup's insurer pays 70 percent
$8,820 to $13,580
Middle car's insurer pays 30 percent
$3,780 to $5,820

The claimant is 0 percent at fault and recovers the full range, but from two insurers on two timelines. If either driver had been uninsured, that share would come from the claimant's own uninsured motorist coverage.

Hypothetical
A left turn crash on US 231 in Lebanon

A driver turning left into a shopping center is hit by an oncoming car. A broken wrist that heals with a cast. The insurer says the turning driver failed to yield and assigns 30 percent of the fault to them.

Medical bills
$14,000
Income lost
$4,500
Multiplier, fracture with recovery
2.5 to 3.5
Before fault
$39,500 to $53,500
After 30 percent fault
$27,650 to $37,450

The 30 percent is the whole argument: if the oncoming driver was speeding or ran a light, a smaller share for the claimant is worth up to $16,000 here.

Hypothetical
An uninsured driver on Lebanon Road in Mount Juliet

Sideswiped by a driver with no insurance. A herniated disc that heals with therapy and injections. The claimant's policy carries $50,000 of uninsured motorist coverage.

Medical bills
$21,000
Income lost
$3,000
Claim range, disc injury with recovery
$55,500 to $76,500
Paid by the at fault driver's insurer
$0
Available from own uninsured motorist coverage
up to $50,000

With one Tennessee driver in five uninsured, this is a common Wilson County outcome. The coverage limit, chosen at renewal, caps the recovery unless the at fault driver has assets worth pursuing.

Representation

When a Wilson County claim needs a lawyer

A clear fault, minor injury claim against one insured driver is often resolved without a lawyer. These Wilson County situations are different:

  • A chain crash with two or more at fault drivers, where each insurer will try to push fault onto the other and the shares decide who pays what.
  • A defendant who blames someone else, where the 90 day window to add that person under T.C.A. § 20-1-119 has to be used.
  • An uninsured or minimum policy driver, where the claim moves to your own coverage and has to be made under its terms.
  • A fracture, surgery or lasting injury, where the value runs into six figures.
  • A crash near the Davidson County line, where the right court has to be chosen within the one year deadline.

The FairSettlement case review asks where the crash happened, who was involved and how you were treated, then shows a range built on the method above. A licensed Tennessee attorney contacts you only if you ask.

Questions people in Mount Juliet ask

Mount Juliet and Lebanon settlement questions

What is a fair car accident settlement in Mount Juliet?

Using the method insurers and lawyers both apply, a soft tissue injury to the neck, back or shoulder settles for roughly $4,000 to $25,000, a fracture or disc injury that heals for $32,000 to $150,000, and an injury with lasting limits for $250,000 or more, before any reduction for your share of fault. Lebanon and the rest of Wilson County follow the same Tennessee rules, so the bands are the same there.

I was hit in a chain reaction crash on I-40. Who pays?

Usually each at fault driver's insurer, for that driver's share. Tennessee abolished joint and several liability in most cases when it adopted comparative fault in McIntyre v. Balentine (1992), so if a jury put 70 percent of the fault on the last car and 30 percent on the middle car, each insurer would owe its percentage of your damages. If one of those drivers is uninsured, your own uninsured motorist coverage is what covers their share.

The driver I sued is blaming another driver I did not sue. Is it too late?

Not necessarily. Under Tenn. Code Ann. § 20-1-119, when a defendant's answer alleges that someone who is not a party caused or contributed to the injury, you have 90 days from that answer to add that person to the case or file a separate suit against them, even if the one year statute of limitations has otherwise run.

How long do I have to file after a Wilson County crash?

Tennessee allows one year from the crash to file an injury lawsuit (Tenn. Code Ann. § 28-3-104), extended to two years only in some cases where the other driver faces criminal charges. A suit over a Mt. Juliet, Lebanon or Wilson County government vehicle must be filed within twelve months under the Governmental Tort Liability Act (§ 29-20-305).

How do I get my Mt. Juliet crash report?

Mt. Juliet Police make crash reports available online at no charge, usually three to five business days after the report is completed. You need the case number, or a driver's last name and the date of the crash. Reports can also be picked up at police headquarters, 1019 Charlie Daniels Pkwy, weekdays from 8 AM to 5 PM.

Which court hears a Mount Juliet or Lebanon injury case?

The Wilson County Circuit Court for the 15th Judicial District, whose clerk is at 134 S College St, Lebanon, (615) 444-2042. Claims up to $25,000 may be filed in General Sessions Court. A crash west of the county line, including at I-40's Old Hickory Boulevard exit, belongs to the Davidson County courts in Nashville.

Which hospitals treat Wilson County crash injuries?

Vanderbilt Wilson County Hospital at 1411 W Baddour Pkwy in Lebanon is the county's hospital. TriStar Summit Medical Center in Hermitage, just across the Davidson County line, is close to western Mount Juliet, and TriStar runs a freestanding emergency room in Mt. Juliet.

Can I recover if I was partly to blame?

Yes, as long as your share of the fault is less than 50 percent; your recovery is reduced by that share (McIntyre v. Balentine, 1992). In a left turn crash on US 231 where you are found 30 percent at fault, a $50,000 claim becomes $35,000.

The driver who hit me has no insurance. What can I recover?

From the driver's insurer, nothing, because there is none. Your own uninsured motorist coverage pays instead, up to its limit. Tennessee policies include it at the same limits as your liability coverage unless you rejected or reduced it in writing (§ 56-7-1201). About 21 percent of Tennessee drivers were uninsured in 2023, according to the Insurance Research Council.

Is pain and suffering capped in Tennessee?

Yes, at $750,000, or $1,000,000 for catastrophic injuries such as paralysis, with no cap when the at fault driver was intoxicated (Tenn. Code Ann. § 29-39-102). Medical expenses and lost income have no cap.
