Until 2025 that fact could not be used in a Georgia injury trial. Senate Bill 68 changed it for lawsuits filed on or after April 21, 2025: a missing seat belt can now be offered on negligence, comparative fault, causation and damages, and used to reduce what the injured person recovers, unless the judge finds the unfair prejudice substantially outweighs its value. In a Henry claim by an unbelted driver or passenger, assume the insurer will raise it. The argument will be about causation: whether a belt would have prevented or lessened this particular injury.

Georgia sends a lawsuit to the county where the defendant lives. A crash on Eagles Landing Parkway with a driver from Riverdale is a Clayton County case, filed at the Harold R.
