What Is a Fair Car Accident Settlement in Alpharetta, North Fulton and Forsyth?
Along GA 400, from Sandy Springs and Roswell through Alpharetta, Johns Creek and Milton to Cumming, a claim is the medical charges times 1.5 to 5 by injury, plus all lost income, minus your share of fault, with no Georgia cap: about $3,750 to $22,500 for a strain or whiplash, $30,000 to $140,000 for a fracture or disc injury and $210,000 and up for surgery, before income. With Forsyth’s median household income at $143,800, lost pay often rivals the medical side.

Medical charges, then the paycheck
North Fulton and Forsyth claims: where lost income can rival the bills
The Georgia formula is the same in Alpharetta as in Atlanta: medical charges times a multiplier for the injury, plus every dollar of income the injury took, minus your share of the fault, with no cap on any of it. What is different along GA 400 is the second term. Forsyth County’s median household income was $143,800 in the Census Bureau’s 2020 to 2024 survey and Fulton County’s $95,300, so for many claims here the time away from work is worth as much as the treatment.
| Injury | From the medical charges | Time off work, at $2,000 a week |
|---|---|---|
| Strain or whiplash, charges of $2,500 to $9,000 | $3,750 to $22,500 | 2 weeks: $4,000 |
| Fracture, herniated disc or concussion, charges of $12,000 to $40,000 | $30,000 to $140,000 | 8 weeks: $16,000 |
| Surgery or a lasting injury, charges of $60,000 and up | $210,000 and up | 26 weeks: $52,000, plus any lost future earning power |
Multipliers of 1.5 to 2.5, 2.5 to 3.5 and 3.5 to 5, the FairSettlement method. $2,000 a week is $104,000 a year; enter your own pay in the estimator below. Incomes: Census American Community Survey 2020 to 2024, via USAFacts.
Lost income has to be proven to count: pay stubs, an employer’s letter on the days missed, tax returns for the self employed, and for a lasting injury an expert’s opinion on future earnings. For a crash on or after April 21, 2025, Georgia also lets the jury weigh what your health plan’s contract requires for the treatment, which can lower the medical side; the Georgia calculator shows the effect.
Two counties, one corridor
Among Georgia’s lowest death rates, with their own pattern
Federal fatal crash records count 61 fatal crashes and 66 deaths in north Fulton from 2020 to 2024, in Sandy Springs, Roswell, Alpharetta, Johns Creek and Milton, and 77 fatal crashes and 81 deaths in Forsyth County. For roughly 388,000 people in the five north Fulton cities, that is about 3.4 deaths a year per 100,000 residents; for Forsyth’s 280,096 it is 5.8. Georgia’s rate was 14.8.
| Traffic deaths | 2020 | 2021 | 2022 | 2023 | 2024 | Total |
|---|---|---|---|---|---|---|
| North Fulton | 15 | 19 | 13 | 7 | 12 | 66 |
| Forsyth County | 12 | 16 | 24 | 16 | 13 | 81 |
NHTSA FARS. North Fulton: Fulton County crashes recorded in one of the five cities or plotted at or north of latitude 33.95; Sandy Springs 28 crashes, Roswell 16, Alpharetta 8, and 9 plotted in north Fulton without a city named. 2024 preliminary.
| Who was killed, 2020 to 2024 | North Fulton | Forsyth |
|---|---|---|
| Drivers | 27 | 46 |
| Pedestrians | 20 | 12 |
| Passengers | 9 | 7 |
| Motorcyclists | 8 | 15 |
| Bicyclists | 2 | 1 |
The two halves of the corridor differ. North Fulton’s dead included 20 pedestrians, almost a third of the total. Forsyth’s included 15 motorcyclists, close to one in five, every one recorded as wearing a helmet, and its crashes more often ran off the road: rollovers, culverts and trees were the first impact in 19 of them.
Speed and alcohol
Forsyth’s fatal crashes involved more speeding and drinking than the metro core
A third of Forsyth’s fatal crashes involved a speeding driver and more than a quarter a driver who had been drinking, higher shares than any of the four large metro counties.
| Fatal crashes, 2020 to 2024 | Speeding involved | A drinking driver |
|---|---|---|
| Forsyth | 34% | 27% |
| North Fulton | 21% | 23% |
| Fulton, whole county | 26% | 15% |
| Cobb | 24% | 22% |
| Gwinnett | 21% | 19% |
| DeKalb | 17% | 20% |
NHTSA FARS: crashes with at least one speeding related driver, and with at least one driver recorded as drinking. Forsyth 26 and 21 of 77; north Fulton 13 and 14 of 61.
Both facts change a claim. Speed is evidence of negligence that comes from the other car’s data recorder and the crash reconstruction. Alcohol does more: when the at fault driver’s judgment was substantially impaired, Georgia’s $250,000 cap on punitive damages no longer applies, and a bar or store that knowingly served a noticeably intoxicated person it knew would soon be driving can share the liability.

GA 400 and the roads that feed it
Across north Fulton and Forsyth, one freeway carries the region, and it led both halves in fatal crashes.
Fifteen in north Fulton and nine in Forsyth. North of I-285 it runs with US 19 through Sandy Springs and Roswell, with exits at Northridge Road (6), Holcomb Bridge Road (7), Mansell Road (8), Haynes Bridge Road (9), Old Milton Parkway (10) and Windward Parkway (11), then into Forsyth at McFarland Parkway (12), Peachtree Parkway (13) and SR 20 at Cumming (14).

The belt question after SB 68
Nearly half the occupants killed were unbelted
Of the 36 drivers and passengers killed in north Fulton from 2020 to 2024, 19 were not wearing a seat belt; in Forsyth it was 22 of 53. For lawsuits filed on or after April 21, 2025, Georgia allows that fact as evidence on negligence, comparative fault, causation and damages, unless the judge finds its value substantially outweighed by unfair prejudice. In a claim by an unbelted driver or passenger, expect the defense to argue that a belt would have reduced the injury, and set the fault slider below with that argument in mind.
Downtown Atlanta or Cumming
Where a north Fulton or Forsyth case is filed
Because Georgia sends a lawsuit to the county where the defendant lives, a crash in Alpharetta does not mean a lawsuit in Alpharetta. For a Fulton resident, that means the State Court in downtown Atlanta.
In the Justice Center Tower, 185 Central Avenue SW, in downtown Atlanta, even for a crash in Milton or Johns Creek. The State Court hears civil cases of any amount, with a jury on request.
Ga. Const. art. VI, § II, para. VI100 Courthouse Square in Cumming, home of the State Court and Superior Court of Forsyth County. A GA 400 crash at Windward Parkway with a Cumming driver is a Cumming case.
Ga. Const. art. VI, § II, para. VITwo at fault drivers from different counties can be sued together in either one.
Ga. Const. art. VI, § II, para. IVIn Fulton or Forsyth, where the crash happened. Above $75,000, federal court: the Northern District’s Atlanta Division for a Fulton crash, its Gainesville Division for a Forsyth crash.

Government vehicles and roads: which notice, which deadline
Every part of north Fulton is now inside a city: Sandy Springs (105,505 residents), Roswell (92,227), Johns Creek (81,167), Alpharetta (67,275), Milton (41,490) and tiny Mountain Park. Forsyth’s only city is Cumming (10,175); the rest of the county is unincorporated and policed by the Sheriff’s Office. GA 400 itself is a state route.
| Vehicle or road of | Written notice | Most it pays one person for a vehicle claim |
|---|---|---|
| A city: Sandy Springs, Roswell, Johns Creek, Alpharetta, Milton, Mountain Park or Cumming | 6 months, with the amount sought | $500,000, more if insured higher |
| Fulton County or Forsyth County, including the Forsyth Sheriff’s Office | 12 months | $500,000, more if insured higher |
| The State of Georgia, including a defect on GA 400 or another state route | 12 months, then 90 days before suit | $1,000,000 |

Reports, courts and the trauma center
Where the paperwork for a GA 400 claim comes from
Each of the five cities has its own police department, which writes the report for a crash inside its limits. Ask the responding agency for the report number at the scene.
Provides accident reports to the public; some are also available at the North and South precincts, by calling ahead. Requests can be made verbally or in writing.
A Level II trauma center, a designation it has held since 1987. A hospital that wants a lien on your claim must give notice and file within 75 days of discharge.
The State Court of Fulton County in downtown Atlanta, and the Forsyth County Courthouse in Cumming, for suits against residents of each county.
Forsyth County Sheriff’s Office, Open Records and GCIC; Wellstar Health System; O.C.G.A. § 44-14-471.

Worked examples
Three GA 400 corridor claims
Illustrations shaped by the area’s crash records, not real cases.
- Herniated disc with injections, billed
- $22,000
- × 3 to 4
- $66,000 to $88,000
- Ten weeks out at $3,200 a week
- + $32,000
- Fair value
- $98,000 to $120,000
Lost pay is a quarter to a third of the claim and is not multiplied, so it has to be proven line by line with pay records and the employer’s letter. If the at fault driver carries $50,000 and the engineer has $100,000 of added on coverage, $150,000 is reachable and the whole range is covered.
- Broken femur, surgery, billed
- $118,000
- × 3.5 to 5, plus $26,000 lost income
- $439,000 to $616,000
- Punitive damages
- uncapped
The driver’s impairment removes the $250,000 punitive cap, and a criminal prosecution pauses the two year filing clock while it runs, for up to six years. If the driver lives in Forsyth, the suit is filed at the courthouse in Cumming.
- Wrist fracture, billed
- $14,500
- × 2.5 to 3.5, plus $6,000 lost income
- $42,250 to $56,750
- Fair value
- $42,250 to $56,750
The crash was in Fulton County, but the at fault driver lives in Forsyth, so the case belongs in Cumming, not in downtown Atlanta. Had the driver lived in Alpharetta, it would have gone to the State Court of Fulton County at the Justice Center Tower.
Questions people in Alpharetta ask
Alpharetta, north Fulton and Forsyth questions
How much is a car accident settlement in Alpharetta?
By the multiplier method, about $3,750 to $22,500 for a strain or whiplash, $30,000 to $140,000 for a fracture, herniated disc or concussion, and $210,000 and up for surgery or a lasting injury, plus every dollar of income lost, minus any share of fault. Georgia caps none of it. In a high income area, the lost income can be as large as the medical side.
Is lost income multiplied in a Georgia car accident claim?
No. In the multiplier method, the medical charges are multiplied to account for pain and suffering, and lost income is added once, in full. That is why it has to be proven with pay stubs, an employer’s letter, tax returns or, for a lasting injury, an expert’s opinion on future earnings.
Where is a lawsuit filed for a crash in Alpharetta or Johns Creek?
In the county where the at fault driver lives. If that driver lives in Fulton County, the case goes to the State Court of Fulton County in the Justice Center Tower, 185 Central Avenue SW, Atlanta. If the driver lives in Forsyth, it goes to the Forsyth County Courthouse, 100 Courthouse Square, Cumming.
Which roads have the most fatal crashes in north Fulton and Forsyth?
GA 400 had 24 fatal crashes from 2020 to 2024, 15 in north Fulton and 9 in Forsyth. Interstate 285 through Sandy Springs and State Route 9 (Roswell Road and Alpharetta Highway) had 10 each, State Route 20 in Forsyth 8, and Holcomb Bridge Road and Browns Bridge Road 6 each.
Are Forsyth County crashes more often caused by speeding or alcohol?
In the federal fatal crash records for 2020 to 2024, 34 percent of Forsyth’s fatal crashes involved speeding and 27 percent a driver who had been drinking, higher shares than Fulton, Cobb, Gwinnett or DeKalb. When the at fault driver was impaired, Georgia’s $250,000 cap on punitive damages does not apply.
How do I get a crash report in north Fulton or Forsyth County?
Sandy Springs, Roswell, Johns Creek, Alpharetta and Milton each have their own police department, which reports crashes inside the city. In unincorporated Forsyth County, the Sheriff’s Office Open Records Unit provides accident reports at the jail lobby in Cumming, and some at its North and South precincts.
How long do I have after a crash in Alpharetta or Cumming?
Two years to sue for injuries and four for car damage (O.C.G.A. §§ 9-3-33, 9-3-31). If a city vehicle or road is involved, written notice to the city within six months; a county or sheriff’s vehicle, within twelve months; the state, including a GA 400 defect, within twelve months.
Which hospital treats serious crash injuries in north Fulton?
Wellstar North Fulton Hospital at 3000 Hospital Boulevard in Roswell, a Level II trauma center since 1987.
I was not wearing a seat belt on GA 400. Does that hurt my claim?
It can, in a lawsuit filed on or after April 21, 2025: Georgia now admits evidence of a missing seat belt on fault, causation and damages, subject to the judge’s power to exclude unfairly prejudicial evidence. In north Fulton, 19 of the 36 occupants killed from 2020 to 2024 were unbelted; in Forsyth, 22 of 53.
Which federal court covers north Fulton and Forsyth?
The Northern District of Georgia: its Atlanta Division for Fulton County and its Gainesville Division for Forsyth County. A case can be filed there, or moved there by the defense, when the driver lives in another state and more than $75,000 is at stake.
