What Is a Fair Car Accident Settlement in Decatur and DeKalb County?
In Decatur, Stonecrest, Brookhaven, Tucker or anywhere in DeKalb County, a claim is worth the medical charges multiplied by 1.5 to 5 for the injury, plus lost income, minus any share of fault: about $3,000 to $22,500 for a sprain or whiplash, $25,000 to $122,500 for a fracture or disc injury, and $245,000 and more for surgery or lasting harm, with no cap. DeKalb had more traffic deaths than any other Georgia county in 2023 and 2024, and more than a third of the dead were pedestrians.

What the numbers come to
DeKalb County claim values, injury by injury
The arithmetic is Georgia’s: the medical charges, scaled up by how badly and how long the injury affects you, plus the wages you lost, minus whatever share of the blame a jury would put on you. Nothing is capped. The cards show where four common injuries land in DeKalb before wages and fault, using charges typical of each.
Charges of about $2,000 to $9,000 for an emergency visit, imaging and a course of physical therapy, multiplied by 1.5 to 2.5.
Charges of about $10,000 to $35,000, multiplied by 2.5 to 3.5. Weeks away from work usually come with it.
Charges of about $25,000 to $50,000 for epidural or facet injections and months of treatment, multiplied by 3 to 4.
Charges from about $70,000 for an operation, a brain or spinal cord injury or permanent limits, multiplied by 3.5 to 5.
The FairSettlement multiplier method applied to illustrative charges; not court averages, which Georgia does not publish.
For a crash on or after April 21, 2025, the jury may also hear what your health plan’s contract requires for the same treatment, so the bottom of each card can fall when your plan pays at a discount. Our Georgia calculator takes both figures.
Federal fatal crash records
Georgia’s deadliest county for traffic in 2023 and 2024
DeKalb County recorded 151 traffic deaths in 2023 and 106 in 2024, the most of any Georgia county in both years, ahead of Fulton, which has 320,000 more residents. Across 2020 to 2024 the county counted 585 fatal crashes and 619 deaths, or 16.1 deaths a year for every 100,000 residents, above Georgia’s 14.8.
| Traffic deaths | 2020 | 2021 | 2022 | 2023 | 2024 |
|---|---|---|---|---|---|
| DeKalb | 91 | 145 | 126 | 151 | 106 |
| Fulton | 145 | 153 | 160 | 112 | 95 |

NHTSA Fatality Analysis Reporting System, by county where the crash occurred; 2024 figures preliminary. Population, Census Vintage 2024: DeKalb 770,307, Fulton 1,090,354.
- 72 percent of the fatal crashes happened in the dark, 420 of 585.
- 116 involved a driver who had been drinking and 102 involved speeding.
- Between moving vehicles, 87 were angle crashes, 68 rear end and 62 head on, the highest head on count of the four large metro counties.
- 109 of the 324 drivers and passengers killed were not wearing a seat belt.
More than a third of the dead
Where DeKalb’s pedestrians were killed
Of the 619 people killed on DeKalb roads from 2020 to 2024, 222 were on foot, 36 percent of the total and nearly twice Georgia’s statewide share of 19 percent in 2023. 184 of them died between 6 p.m. and 6 a.m. The federal records also name the road for each crash in which a pedestrian was the first person struck, 203 crashes in all, and they cluster on a short list.
| Road | Fatal pedestrian crashes, 2020 to 2024 |
|---|---|
| Interstate 285 | 21 |
| State Route 155: Candler Road and Flat Shoals Parkway | 19 |
| Interstate 20 | 14 |
| State Route 10: Memorial Drive | 14 |
| Covington Highway, recorded as SR 12 or US 278 | 12 or more |
| Interstate 85 | 7 |
| State Route 13: Buford Highway | 6 |
NHTSA FARS crashes whose first harmful event was a pedestrian, by trafficway, DeKalb County, 2020 to 2024. Some Covington Highway crashes are coded under other route numbers, so its count is a floor.
Two features of these claims stand out. Many happen on interstates, where a person on foot is rare and the fault picture depends on why they were there. And on the arterials, the questions are lighting, crossing location and speed: Georgia requires a pedestrian outside a crosswalk to yield, while every driver must still use due care to avoid anyone in the road.
Seventy eight drivers who left
Hit and run in DeKalb: the claim against your own policy
In 78 of DeKalb’s 585 fatal crashes, a driver left the scene: 13 percent, against 11 percent in Fulton, 8 percent in Cobb and 6 percent in Gwinnett over the same years. When the driver is never identified, there is no liability policy to claim against, and the money comes from uninsured motorist coverage.
Georgia’s coverage for an unknown driver requires physical contact with your person or property, or an eyewitness other than you who backs up your account of how it happened.
O.C.G.A. § 33-7-11(b)(2)The named insured and relatives living in the same household are covered while in a motor vehicle or otherwise, so a family policy can pay for a member struck while walking.
O.C.G.A. § 33-7-11(b)(1)(B)With no at fault policy to add to, the reach of the claim is your own uninsured motorist limit, the same under added on and reduced by coverage.
O.C.G.A. § 33-7-11(b)(1)(D)When a suit is filed against an identified uninsured driver, a copy must be served on your own insurer as though it were a defendant.
O.C.G.A. § 33-7-11(d)116 fatal crashes with a drinking driver
When alcohol was involved: three Georgia rules that change a DeKalb claim
One in five of DeKalb’s fatal crashes from 2020 to 2024 involved a driver who had been drinking, 116 of 585. The share was similar in Cobb, 70 of 312, and lower in Fulton, 91 of 607. When a drinking driver caused your injury, three rules come into play that do not apply to an ordinary crash.
Georgia’s $250,000 limit on punitive damages falls away when the defendant was under the influence of alcohol or drugs to the point that judgment was substantially impaired. Punitive damages still need clear and convincing proof.
O.C.G.A. § 51-12-5.1(b), (f)A seller or server is liable only if it knowingly served someone in a state of noticeable intoxication, or willfully, knowingly and unlawfully served someone under 21, knowing the person would soon be driving, and the serving was a proximate cause of the injury.
O.C.G.A. § 51-1-40(b)If the driver is prosecuted for the crash, the two year limit for the injured person’s civil claim is paused until the criminal case ends, for up to six years.

DeKalb’s most dangerous corridors in the federal record
All 585 fatal crashes, grouped by the road the federal record names. The Perimeter and I-20 alone account for almost a quarter.
DeKalb holds the Perimeter’s whole eastern arc, from the Fulton line near Dunwoody past Spaghetti Junction at I-85, Tucker and the US 78 interchange, down to I-20 and around toward Clayton County.
East from the Atlanta line through the south of the county, past Candler Road and Panola Road to Stonecrest and Lithonia at the Rockdale line.
Candler Road and Flat Shoals Parkway through south DeKalb, the road with the most fatal pedestrian crashes after I-285.
Memorial Drive from the Atlanta line east toward Stone Mountain, recorded together with the Stone Mountain Freeway stretch of the same route.
The northern edge of the county, from Brookhaven and Chamblee through Doraville to the Gwinnett line.
US 278 and State Route 12 across the south center of the county toward Lithonia, counted here only where the record uses those numbers.
The corridor through Brookhaven, Chamblee and Doraville toward Gwinnett.

Thirteen cities, four of them new
Which DeKalb government gets your notice
DeKalb has thirteen municipalities, counting the part of Atlanta inside the county, and four of them did not exist two decades ago: Dunwoody became a city in 2008, Brookhaven in 2012, Tucker in 2016 and Stonecrest in 2017. A crash involving one of their police cars, trucks or roads is a city claim with a six month notice, not a county claim, and the notice goes to that city’s mayor or council chair with the amount you are seeking.
| Government involved | Deadline for written notice | Most it pays one person for a vehicle claim |
|---|---|---|
| A city: Stonecrest, Brookhaven, Dunwoody, Tucker, Chamblee, Decatur, Clarkston, Doraville, Stone Mountain, Lithonia, Avondale Estates, Pine Lake or Atlanta | 6 months | $500,000 unless insured higher |
| DeKalb County | 12 months | $500,000 unless insured higher |
| The State of Georgia | 12 months, then a 90 day wait | $1,000,000 |
O.C.G.A. §§ 36-33-5, 36-11-1, 36-92-2, 50-21-26, 50-21-29. City populations, Census Vintage 2024: Stonecrest 61,015; Brookhaven 59,370; Dunwoody 51,795; Tucker 37,224; Chamblee 32,321; Decatur 24,482.
Filing in Decatur, or not
Where a DeKalb case is heard
The DeKalb County Courthouse at 556 North McDonough Street in Decatur is home to the State Court and the Superior Court. Whether a DeKalb crash ends up there turns on where the other driver lives, because Georgia’s constitution sends a civil case to the defendant’s county.
- A DeKalb resident at fault: the State Court of DeKalb County in Decatur, with a jury if either side asks, or the Magistrate Court for claims of $15,000 or less.
- A driver who lives in Fulton, Gwinnett, Rockdale or another county: that driver’s home county, even for a crash on Memorial Drive.
- Two at fault drivers from two counties: either county.
- A driver from out of state: DeKalb, where the crash happened, or above $75,000 the federal court in Atlanta, the Northern District of Georgia’s Atlanta Division.
Ga. Const. art. VI, § II, paras. IV and VI; O.C.G.A. §§ 15-10-2, 40-12-3; 28 U.S.C. §§ 90, 1332.

Worked examples
Three DeKalb claims, worked through
Illustrations drawn from the patterns in the county’s crash records, not actual cases.
- Broken arm and ribs, billed
- $27,000
- × 2.5 to 3.5, plus $4,800 lost wages
- $72,300 to $99,300
- Jury finds 25 percent fault for crossing away from a crosswalk
- − $18,075 to $24,825
- Fair value
- $54,225 to $74,475
The driver is never found. The pedestrian was struck, which is physical contact, so the household’s auto policy, including its uninsured motorist coverage, can respond even though the injured person was on foot. With $50,000 of that coverage the claim falls short of even the low end; with $100,000, the whole range is reachable.
- Concussion and shoulder injury, billed
- $19,500
- × 2.5 to 3.5, plus $3,200 lost wages
- $51,950 to $71,450
- Fair value
- $51,950 to $71,450
Brookhaven has been a city since 2012, so the claim goes to Brookhaven, not DeKalb County: a written notice within six months, delivered to the mayor or council chair, stating the time, place and extent of the injury and the specific amount sought. Miss that date and the claim can be lost long before the two year limit.
- Whiplash with three months of therapy, billed $11,000; plan contract amount
- $4,700
- Low end: $4,700 × 2, plus $1,800
- $11,200
- High end: $11,000 × 3, plus $1,800
- $34,800
- Fair value
- $11,200 to $34,800
The crash came after April 21, 2025, so the plan’s contract amount is part of the evidence and the low end drops. The driver lives in Rockdale County, so the lawsuit would be filed in Rockdale, not at the courthouse in Decatur.
Questions people in Decatur ask
Decatur and DeKalb County car accident questions
What is a fair car accident settlement in DeKalb County?
Using the multiplier method, roughly $3,000 to $22,500 for a sprain or whiplash, $25,000 to $122,500 for a fracture, disc injury or concussion, $75,000 to $200,000 when injections and continuing spine care are needed, and $245,000 and more for surgery or lasting harm, before income and fault. Georgia does not cap any of it. If the crash was on or after April 21, 2025, what your health plan’s contract requires for the same care is also evidence and can lower the bottom figure.
Is DeKalb County the most dangerous county in Georgia for traffic deaths?
By count, it had the most traffic deaths of any Georgia county in 2023 (151) and 2024 (106), according to NHTSA’s fatal crash records. Over 2020 to 2024 its rate was 16.1 deaths a year per 100,000 residents, against 14.8 statewide; several smaller rural counties have higher rates.
Which DeKalb roads have the most pedestrian deaths?
In crashes where a pedestrian was the first person struck, 2020 to 2024: Interstate 285 had 21, Candler Road and Flat Shoals Parkway (State Route 155) 19, Interstate 20 and Memorial Drive 14 each, and Covington Highway at least 12.
The driver who hit me in DeKalb drove off. Can I still get paid?
Usually through your own uninsured motorist coverage. Georgia requires physical contact with you or your vehicle, or an eyewitness other than you, when the driver is never identified (O.C.G.A. § 33-7-11(b)(2)). The coverage protects household members on foot as well as in a car.
Where do I file a lawsuit for a crash in Decatur?
In the county where the defendant lives. A DeKalb resident is sued in DeKalb, usually in the State Court at the DeKalb County Courthouse, 556 North McDonough Street. A driver from another Georgia county is sued in that county, and an out of state driver can be sued in DeKalb or, above $75,000, in federal court in Atlanta.
A Brookhaven or Dunwoody police car hit me. What do I do first?
Give the city written notice within six months, addressed to the mayor or council chair, stating the time, place and extent of the injury, the negligence and the specific amount you seek (O.C.G.A. § 36-33-5). Brookhaven, Dunwoody, Tucker and Stonecrest are all cities now, so their vehicles follow the city rule rather than DeKalb County’s 12 month rule.
How do I get a DeKalb County police crash report?
Reports for crashes worked by DeKalb County police can be bought through BuyCrash, or requested from the Police Records Section at 1960 West Exchange Place in Tucker in person or by mail. Crashes inside cities with their own police, such as Brookhaven, Dunwoody, Chamblee and Doraville, are reported by those departments.
How long do I have to sue after a DeKalb County crash?
Two years for an injury claim and four years for damage to your car (O.C.G.A. §§ 9-3-33, 9-3-31). If the at fault driver is prosecuted for the crash, the two years pause until the prosecution ends, for up to six years (§ 9-3-99).
Does it matter that I was not wearing a seat belt?
In a lawsuit filed on or after April 21, 2025, it can: Georgia now allows evidence of a missing seat belt on fault, causation and damages, though a judge may exclude it if it is unfairly prejudicial. In DeKalb, 109 of the 324 drivers and passengers killed from 2020 to 2024 were not belted.
Is there a cap on what I can recover in DeKalb?
No cap on compensatory damages. Punitive damages are capped at $250,000 unless the driver acted with intent or was impaired by alcohol or drugs, in which case there is no cap (O.C.G.A. § 51-12-5.1). In DeKalb, 116 of the fatal crashes from 2020 to 2024 involved a drinking driver.
